What is behind it

1Tool, based in 8435 Wagna, Austria, informs you below for what purpose and to what extent your personal data is collected, stored and used by us in the course of using our web application and apps. IMPORTANT FIRST: Your data will not be passed on without your consent, unless there is a legal obligation to do so.

Collection of personal data

Personal data is only collected if you provide it to the 1Tool web application by completing the relevant form on the www.1tool.com website. The data provided will not be passed on to third parties. We use the following data:
General data – if you conclude a contract with us, we process the following data:

Your master data: Surname and first name, academic degree, address and contact information (e.g. e-mail address, telephone number), information about the nature and content of our contractual relationship.
Other personal data that you or third parties provide to us with your consent or otherwise permissibly when initiating a contract or during the contractual relationship, i.e: Date of birth or age, marital status, gender. This term does not include any data that is sensitive under data protection law, in particular racial and ethnic origin, political opinions, religious or ideological beliefs, trade union membership, genetic or health data.

Use of collected data

The company uses personal data of 1Tool customers to provide the requested services. For example, if you fill out an online contact form, we will use this information to contact you regarding your interest in the services. This data is stored and used exclusively for the purpose of responding to your request or for establishing contact and the associated technical administration. Your data will be deleted after final processing of your request, provided that you request this and there are no statutory retention obligations to prevent deletion. The company may also use personal data of 1Tool customers and data of participants for marketing purposes. For example, the Company may use information you provide to contact you to discuss your interest in the Services and to provide you with information about the Company.

You can assert the following rights with regard to the processing of your data

If you have concluded a contract with us, we will generally delete your master data and other personal data at the end of the 7th (seventh) year after the last use, but no later than the expiry of all statutory retention obligations (e.g. pursuant to Section 212 UGB or Sections 207 f BAO in the applicable version)
Data transmitted exclusively for the purpose of initiating a contract will be deleted after 14 days.

Right to information

You can request confirmation from us as to whether and to what extent we process your data.

Right to rectification

If we process your personal data that is incomplete or incorrect, you can request that we correct or complete it at any time.

Right to erasure

You can request that we erase your personal data if we process it unlawfully or if the processing disproportionately interferes with your legitimate protection interests. Please note that there may be reasons that prevent immediate erasure, e.g. in the case of statutory retention obligations.

Right to restriction of processing

You can request that we restrict the processing of your data if

you contest the accuracy of the data, for a period enabling us to verify the accuracy of the data.
the processing of the data is unlawful, but you refuse to have it erased and instead request that the use of the data be restricted,
we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims, or
you have objected to the processing of the data.

Right to data portability

You can request that we provide you with the data that you have entrusted to us for storage in a structured, commonly used and machine-readable format, provided that

we process this data on the basis of your revocable consent or for the performance of a contract between us, and
this processing is carried out by automated means.

Right of objection

If we process your data to perform tasks in the public interest, to exercise official authority or if we rely on the necessity to safeguard our legitimate interests when processing your data, you can object to this data processing if there is an overriding interest in protecting your data. You can object to the sending of advertising at any time without giving reasons.

Right of appeal

If you are of the opinion that we are violating Austrian or European data protection law when processing your data, please contact us so that we can clarify any questions you may have. Of course, you also have the right to lodge a complaint with the Austrian data protection authority, and from 25.5.2018 also with a supervisory authority within the EU.

Order data processing

Web hosting provider

On the basis of a separate agreement on the processing of personal data on our behalf, your data is managed by our web hosting provider Brunner Webhosting, Pöttmesserweg 4, A-4400 Steyr. Brunner Webhosting has been carefully selected by us as a specialized service provider and is regularly reviewed by us to ensure that your privacy is protected. Brunner Webhosting only processes your personal data on our behalf and on our instructions and may only use your personal data for the purposes specified by us. Compliance with these data protection provisions and the necessary security measures is guaranteed at all times.

Data center

Our server location is in Austria in the eww ITandTel data center. eww ITandTel has been carefully selected by us and is regularly checked by us to ensure that your privacy is protected. ITandTel may only use your personal data for the purposes specified by us. Compliance with these data protection provisions and the necessary security measures is guaranteed at all times.

Use of cookies

“Cookies” are small files that enable us to store specific information relating to you, the user, on your PC or digital device while you are visiting one of our websites. Cookies help us to determine the frequency of use and the number of users of our website, as well as to make our offers as convenient and efficient as possible for you. The content of the cookies we use is limited to an identification number and usage data that cannot be traced back to the user. It is also possible to use our services without cookies, but this may limit their use. We only set cookies that are not technically necessary with your explicit consent. On your first visit a cookie prompt asks for it; “I agree” and “I do not agree” are equal choices. We store your decision with its time in your browser (local storage, not a cookie). You can withdraw your consent at any time with effect for the future via “Cookie settings” at the bottom of the page. The legal basis is your consent (Art. 6(1)(a) GDPR, § 165(3) Austrian Telecommunications Act 2021). For us, data protection is an essential contribution to customer satisfaction. You can therefore deactivate the storage of cookies in your browser, restrict them to certain websites or set your browser to notify you as soon as a cookie is sent. You can also delete cookies from your PC’s hard disk at any time. Please note, however, that in this case you will have to reckon with a limited display of the site and limited user guidance

Reach measurement with Matomo

We measure how often our pages are visited with the open-source software Matomo on a server operated by us (stats.1hosting.com). On our sites Matomo sets no cookies and is not combined with other data. It processes the page visited, the time, the referring page and the browser and device type. The legal basis is our legitimate interest in measuring the reach of our website (Art. 6(1)(f) GDPR).

Measuring the success of our advertising: Google Ads and Meta Pixel

We advertise 1Tool on Google and on Meta (Instagram, Facebook). To see which ad led to an enquiry or a signup for the free trial, we use Google Ads on www.1tool.com and demo.1tool.com and the Meta Pixel on demo.1tool.com – only if you choose “I agree” in the cookie prompt. Without your consent they are not loaded. The legal basis is your consent (Art. 6(1)(a) GDPR, § 165(3) Austrian Telecommunications Act 2021); you can withdraw it at any time via “Cookie settings” at the bottom of the page.

Google Ads conversion tracking

The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). After a click on one of our Google ads, Google stores a cookie (_gcl_au, retention 90 days) with a click identifier. If the visitor then signs up for the trial or sends an enquiry, Google learns that a conversion belongs to this ad. We only see aggregated figures, not individual persons. Processed are in particular the click identifier, time, pages visited, IP address and browser and device data. We do not pass your e-mail address to Google. We use Google’s Consent Mode: until you consent, all advertising functions are switched off.

Google may transfer data to Google LLC in the USA. Google LLC is certified under the EU-US Data Privacy Framework, for which an adequacy decision of the European Commission exists. More in Google’s privacy policy.

Meta Pixel

The provider is Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland (“Meta”). The Meta Pixel is a small program that tells Meta that you have visited our page and, where applicable, started or completed a signup for the trial. Meta sets a cookie for this (_fbp, retention 90 days). Processed are in particular the page visited, the event (page view, signup started, trial confirmed), time, IP address and browser and device data. If you are logged in to Facebook or Instagram, Meta can link this information to your account. We use the data to measure the success of our ads and to show visitors of our pages relevant ads later (remarketing). We do not pass your e-mail address to Meta.

We are jointly responsible with Meta for collecting the data and transmitting it to Meta (Art. 26 GDPR); the agreement is available at facebook.com/legal/controller_addendum. Meta alone is responsible for any further processing. Meta may transfer data to Meta Platforms, Inc. in the USA, which is certified under the EU-US Data Privacy Framework. Location access in the 1Tool app

The 1Tool app requires access to your location in order to be able to carry out time recording correctly. This location data is used exclusively to record the start and end of your working hours – in particular to check whether you are at an authorized location at the time of time recording (e.g. at the workplace or on a defined construction site). Why we use location data:
To enable location-based working time check-ins and check-outs. To ensure that time recording only takes place at authorized locations. For documenting the position during time recording – for internal traceability and quality assurance. What happens to your location data:
The location data is not stored permanently, but only processed temporarily in order to carry out the time recording function. It will not be passed on to third parties. The data is not used for tracking purposes outside of the app functionality. Data protection and transparency:
Your location data is collected and used in accordance with our privacy policy, which you can view at any time.

Liability

These partners generally have their own privacy statements and/or policies. We also assume no responsibility or liability for these declarations and guidelines that are not related to IP Österreich GmbH.

Period of validity

This privacy policy applies from January 1, 2018 and replaces the data protection provisions in the applicable GTC.
